Court Strikes Down FCC Indecency Policy

The U.S. Court of Appeals for the Second Circuit has made its decision in Fox Television Stations v. the FCC, with the three-judge panel deciding that the FCC's policy on fleeting indecency violates the First Amendment because it is unconstitutionally vague, and therefore creates a "chilling effect" on speech. The court has therefore vacated the policy, which dates back to 2004. FCC Chairman Julius Genachowski said in a brief statement that the commission is reviewing the court's decision.

NAB Pleased With Court Decision On FCC Indecency Policy

The NAB says it supports the Second Circuit Court of Appeals' decision to vacate the FCC's policy on fleeting indecency. NAB EVP Dennis Wharton said, "We believe that responsible decision making by network and local station executives, coupled with program blocking technologies like the V-chip, is far preferable to government regulation of program content."

MMTC, Other Groups Weigh In On Ownership Review

The Minority Media and Telecommunications Council and other groups, under the banner of the Diversity and Competition Supporters, file its comments on the FCC's NPRM on the 2010 quadrennial ownership rules review calling on the FCC to "examine market entry barriers that cause minority exclusion: access to spectrum, access to capital, and access to opportunity."

The Enid Public Radio Association is issued a $10,000 notice of apparent liability over low-power KEIF in Enid, OK, as the FCC says the station operated at an antenna height greater than that authorized and aired unauthorized commercial announcements.
