LEGAL - Lowest Unit Rate and Internet Streaming

As we enter into the political season, radio stations are being bombarded with reminders about the FCC?s political broadcasting rules and the lowest unit rate(?LUR?) requirements for spots sold to qualified political candidates. As many of you already know LUR means that stations must provide all political candidates (federal, state and local) with the LUR for the advertising that such candidates purchase within a statutorily specified pre-election window. We wanted to make sure you also knew the online rules in case you are streaming your station.
The LUR windows are: (a) 45 days before a primary election, and (b) 60 days before a general election. In general terms, the LUR is the lowest rate of the station for a particular class and amount of time during a particular period. Thus, the LUR allows candidates the benefit of the lowest rates, including all discounts, offered to the station?s most favored commercial advertisers for the same class and amount of time for the same period as that purchased by the candidate. Only candidate ads are entitled to receive LUR, and federal candidates must provide the ?stand by your ad? certification in order to be entitled to receive the LUR.
A spot class is one that has particular rights and characteristics, such as morning drive versus afternoon drive. But the treatment of package rates under the LUR requirements can be very complicated. For Federal candidates, who cannot be turned down by a station (unlike state and local candidates) stations must break up packages to determine if the spots in that package affect the LUR.
However, increasingly, as radio stations are streaming content on the internet, there has been some confusion as to how the LUR requirements apply to spots streamed over the internet. First, you should know that the LUR requirement does not apply to internet-only advertising time. However, broadcasters operating websites should be careful to distinguish sales of internet-only advertising time from sales of over-the-air advertising time, especially if an advertising package includes broadcast spots as well as internet-only advertising, such as providing banner ads to over-the-air advertisers who purchase a certain advertising package.
Such packages may impose obligations on a station with respect to political advertising sales and the value of the internet component may impact the station's LUR. If a station offers a combined package of broadcast and internet advertising, LUR rules will apply. Also, remember that the equal time requirements apply so if the station sells a package with broadcast spot time and internet spots to one candidate, then the same should be made available to competing candidates for the same office. In short, be careful when selling combined broadcast and internet advertising packages and be aware of how such bundling may impact the LUR and your bottom-line.

WQKL Collects 203 Tons of Food For Hungry

WQKL is in Ann Arbor Michigan where PD Chris Ammel lets us know that in only five days his team collected 203 tons of food for the local food bank, despite a challenging economy. "Volunteers and radio personalities braved long hours, and at times, frigid weather outside Kroger to collect food and donations for the Food Gatherers? food rescue and food bank program."

On behalf of all the people seeking food assistance this year, we are so grateful to ann arbor?s 107one, Kroger and the citizens of Washtenaw County for making a real difference in our community. When we needed you most, you rose to the challenge." Food Gatherers is Washtenaw County?s food bank and food rescue program. Since its inception in 1988, Food Gatherers has distributed more than 39 million pounds of food for the community.

HOT 97 NY Donates Hundreds of Toys to Kids

The HOT 97 Hip-Hop Has Heart Foundation has gone on another giving spree donating hundreds of toys to three local organizations; Harlem Hospital, Emergency Rights and Area 145 Daycare. For their 5th consecutive year, HOT 97?s Hip-Hop Has Heart Foundation join hand-in-hand with its celebrity DJ?s to give children a reason to look forward to the season.
HOT 97?s Angie Martinez and L Boogs, dropped off the toys to Harlem Hospital?s Children?s Christmas Celebration. HOT 97?s DJ C-Lo will took to the streets handing out toys in the Bronx for Emergency Rights? 9th Annual Toy Drive. And, HOT 97?s Peter Rosenberg and J Medina made the final stop at Area 145 Daycare in Harlem?s Annual Holiday Party.

Townsquare Tear Jerker in Buffalo

Every year WBLK-FM in Buffalo teams with the Child & Family Services. First names and Christmas toy wishes of up to 15 local children who may not receive anything on Dec 25th are chosen. WBLK then turns to listeners and asks them to donate a gift, (or complete the child's wish). WBLK then produced a special ?Christmas for Kids? party at the Child & Family Services building.
WBLK provided Santa helpers, music and refreshments and the listeners who donated gifts were invited to join WBLK at the party to view the presentation of gifts to each child. The kids range from 20 months to 12 years old and all have been a ward of the state or neglected in some way. The mission is to bring awareness to the growing plight of children who need a permanent home through adoption and or foster care. On Dec 17th at least for a few hours, a child?s sadness was replaced with the tears of joy with the 93.7 WBLK Christmas for Kids outreach program.

We all know that it is important for radio to be available to listeners on social media platforms. It is ?being there? for them in the new forms of social environment important because your listeners are spending time there. Often lots of time. After all, if you are not on platforms like Facebook and Twitter, listeners will find other things to replace you and you will lose critical opportunities to grow closer to important listeners and those they influence.
If you?ve read anything I have written on social media, you know well that I suggest having a specific strategy to reach your goals. If you don?t know where you are going, you often end up somewhere else. These tools can help you manage your efforts, but it is also important to bring your team (no matter how small) together to understand your goals and work to bring everything together for your success in 2012.

Very interesting article. You don't hear too much about social media and radio beyond contests etc, so it was interesting to get an inside perspecitive.
