David DuBose was in a unique position in Birmingham, Alabama. As the Market Manager for Cox he was responsible for preparing budgets for the company. When the stations went up for sale, he was also part of SummitMedia, the group that eventually purchased the Birmingham cluster, giving him inside information about the financials. Now, DuBose is claiming in his lawsuit, for back pay that Cox directed him to prepare "unrealistic and wholly unreachable revenue and expense targets for 2012."
Dubose claims, "Cox used these inflated and unrealistic figures in preparing revenue reports for their eight Birmingham-area radio stations in calculating the stations' performance goals for 2012. Upon information and belief, Cox also used inflated and unrealistic figures in preparing the revenue reports for radio stations outside of the Birmingham market which were eventually sold by Cox for the purpose of enhancing the sale prices of those stations."
When asked for a comment about the DuBose allegation, a Cox spokesman said they do not comment on pending litigation.
