Attorneys for Bubba Clem, a.k.a. Bubba The Love Sponge, and the Bubba Radio Network have filed a motion to dismiss Nielsen Audio's lawsuit over Clem's admitted inappropriate contact with a PPM panelist in the Tampa market. The motion, filed in the U.S. District Court in Tampa by the Todd Foster Law Group, claims the matter doesn't belong in federal court, and that Nielsen has failed to "state a claim upon which relief can be granted." The motion says, "Nielsen's complaint bites off more than it can chew, attempting and failing to rewrite an isolated instance of poor judgment which admittedly did not impact its ratings measurements into a noisy tale of pervasive fraud that has damaged an entire industry."
