The FCC has denied a petition for reconsideration filed by Maka'ainana Broadcasting Co., which was selected for a new NCE station at Kaneohe, Hawaii but later saw its selection rescinded after a rival applicant filed a petition to deny with the FCC's Media Bureau.
The other applicant, Calvary Chapel of Honolulu, alleged that MBC wasn't an "established local applicant" and had no activity in the community. MBC responded that it had formed primarily to file the application and had no other business activities, but it had an office in the area for more than two years. The Media Bureau agreed that CCHI had made its point and referred the matter to the commission. After MBC submitted further documentation, the commission found it wasn't an actively operating organization, and took away the points it had earned on its applications as an established local applicant. Calvary Chapel became the new tentative selectee.
MBC filed both a petition for reconsideration of the commission decision and a petition to deny CCHI's application, and the commission has now dismissed the petition for reconsideration on procedural grounds and denied the petition to deny.
