In Arbitron's Sights: L.M. Communications

8-12-2013

In a suit filed in U.S. District Court for the Eastern District of Kentucky, Arbitron alleges that L.M. -- which has stations in Kentucky, West Virginia, and South Carolina -- infringed on Arbitron's copyrights when its Charleston, SC stations "illicity obtained" copies of Arbitron reports, databases, and estimates.

Arbitron also alleges that LM management, "including but not limited to LMC President and CEO Lynn Martin," "requested, instructed others to obtain, and illicitly obtained" the Arbitron information, and used it for various purposes, including setting rates for advertisers and making programming decisions. Arbitron says this went on through at least 2009-2013 at L.M.'s Charleston, SC stations.

L.M. has not yet responded to the complaint, which was filed last week.
