Court Vacates FCC Indecency Policy
The U.S. Court of Appeals for the Second Circuit has made its decision in Fox Television Stations et al. v. the FCC, with the three-judge panel deciding that the FCC's policy is so vague that it violates the First Amendment and creates a "chilling effect" that goes well beyond the fleeting expletives in question in the case. The court has therefore vacated the FCC order and the underlying policy on fleeting indecency. More soon at www.radioink.com .
